We write today only to clarify that there is no constitutional right to smoke. <br /> It is clear that tobacco smoke causes irritation to the eyes, nose, throat and/or lungs of many non- <br /> smokers. The ACLU believes these harms are sufficient to justify carefully tailored government <br /> regulation of smoking in public places. <br /> The mission of the ACLU of Hawaii is to protect the fundamental freedoms enshrined in <br /> the U.S. and State Constitutions. The ACLU of Hawaii fulfills this through legislative, litigation, <br /> and public education programs statewide.
