The property is located along the south side <br /> of the Puainako Street Extension, southwest of the Sunrise Estates Subdivision, Increment I, <br /> <br /> Kukuau I", South Hilo, Hawaii, TMK: 2-4-8:14. <br /> PROPOSED ACTION <br /> <br /> 1. Request: Amendment to Condition C (final subdivision approval) of Ordinance No. 93 <br /> 36. The applicant requests a five-year extension of time to comply with Condition C to <br /> <br /> secure final subdivision approval. Condition C currently reads: <br /> "Subdivision plans for the proposed development shall be submitted to the <br /> <br /> Planning Department within one year from the effective date of the change of <br /> zone. Final Subdivision Approval shall be secured within two years from the date <br /> <br /> of receipt of Tentative Subdivision Approval." <br /> (Exhibit 1 - January 23, 2008 letter) <br /> <br /> 2. Background: Ordinance No. 93 36 rezoned approximately 171.84 acres from an <br /> Agricultural (A-20a, A-10a, and A-3a) to the Residential and Agricultural (RA-la) <br /> <br /> district to allow the development of a 140 one-acre lot subdivision. The applicant has yet <br /> to comply with Condition C of the ordinance, which required that Final Subdivision <br /> <br /> Approval be secured within two years from the receipt of Tentative Subdivision <br /> Approval. Reasons for the Request: The applicant requests the additional time for compliance due <br /> <br /> to the County's realignment, acquisition and construction of the Puainako Street <br /> Extension through the property, which required the revision of the final plat map to <br /> <br /> conform to the new road right-of-way.
