Bmccu102.sU-1/7/98

COUNTY OF HAWAII PLANNING DEPARTMENT
BACKGROUND REPORT

JAMES MCCULLY
CHANGE OF ZONE APPLICATION (REZ 97-17)

JAMES MCCULLY is requesting a Change of Zone by changing the district

classification from Limited Industrial (ML-20) and Industrial-Commercial Mixed (MCX-20),
for approximately 14.234 acres of land. The property is located approximately one mile east

of the Keaau Town Center at the end of Milo Street in the vicinity of the former Puna Sugar

Company Mill site, Keaau, Puna, Hawaii, TMK: 1-6-3:05 (Portion).
GENERAL INFORMATION

I. Landowner Authorization: The landowner of the subject property is James and
Francine McCully.

2. Permission to Use Roads: The subject property is bound by private roads along the
north and south property boundaries. Permission to use these private roads have been

granted by deed from W.H. Shipman, Ltd. (See Exhibit A)
3. Ordinance No. 97-66 and Ordinance No. 97-67: The County Council approved

Ordinance No. 97-66, effective May 14, 1997, which redesignated a 14+-acre portion

of the subject property that fronts the private section of Milo Street from State Land
Use Agricultural to Urban. The County Council also approved Ordinance No. 97-67

to rezone the subject property from A-20a to ML-20 and FA-3a, effective
May 14, 1997. The applicant intended to develop a mixture of industrial and

agricultural lots to service the needs of the community and region in the Puna District.
The ML-20 zoning would allow for approximately 14-one-half to one acre sized fee

simple lots and the remaining 17±-acre portion that was rezoned to FA-3a would
allow the creation of five 3-acre lots.

APPLICANT'S R_F.OUEST
4. Request: The applicant is requesting that the existing ML-20 zoned portion of the

subject property be rezoned to MCX-20 to allow for a greater mix of uses.
