<br /> <br /> <br /> <br /> <br /> Meala0l.sso-4\09\98 <br /> <br /> <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> <br /> KEALAKEKUA DEVELOPMENT CORPORATION <br /> AMENDMENT TO CONDITIONS B, C AND Y OF <br /> CHANGE OF ZONE ORDINANCE NO. 95-70 (FZ No 798) <br /> <br /> Kealakekua Development Corporation has submitted a request for amendment to <br /> <br /> Conditions B, C and Y of Ordinance No. 95 70, which reclassified lands from an Agricultural <br /> (A-20a) to Agricultural (A-la, A-3a, A-200a, A-255a, and A-8000a) zoned districts. The <br /> <br /> amendment to the conditions relates to water source and system requirement, incremental <br /> development, and performance requirement. The property is located between the 2,200- and <br /> <br /> 6,000-foot elevation, east (mauka) of Captain Cook and approximately 5,700 feet east of the <br /> Mamalahoa Highway and Koa Road intersection, Kealakekua, Kiloa, Wapunaula, Kalama, <br /> <br /> Kumu and Kalamakowali, South Kona, Hawaii, TMK: 8-2-12:12 & Portion of 1. <br /> GENERAL. INFORMATION <br /> <br /> 1. Land Ownership: Kealakekua Development Corporation purchased the subject <br /> property from Kealakekua Ranch (Greenwell Ranch) in 1990. Kealakekua <br /> <br /> Development Corporation is a wholly owned subsidiary of Tokuju Company, Ltd. <br /> <br /> BACKGROUND INFORMATION <br /> 2. January 9, 1990 - The Planning Director approved Subdivision No. 5845 for a three <br /> <br /> lot subdivision. <br /> 3. June 6, 1994 - Office of State Planning filed application for State Land Use Boundary <br /> <br /> amendment to reclassify approximately 10,895 acres of land from Agricultural to <br /> Conservation. <br /> <br /> 4. July 8, 1994 - Kealakekua Development Corporation and the Office of State Planning <br /> reached a negotiated settlement for the protection of approximately 8,100 acres for a <br /> <br /> minimum of 40 years. KDC agreed to establish a forest management plan for <br /> approximately 8,100 acres for a minimum of 40 years. The property will be placed <br /> <br /> under a restrictive covenant to be filed with the Bureau of Conveyances. KDC dropped <br /> a request in Third Circuit Court to invalidate Office of State Planning's Amendment <br /> <br /> <br /> <br /> <br /> ATTACH. C-822 <br /> (B-232) <br />
