Arakaki, Chairman <br /> and Members of the County Council <br /> Page 3 <br /> <br /> <br /> The proposed Rural boundary amendment request is compatible with the <br /> statutory definition for low-density residential uses with a minimum lot size of one-half <br /> acre. The applicant has stated that the requested size (1/2 acre) would provide a <br /> needed buffer and transition between the agricultural and urban uses. It is also possible <br /> to have some limited backyard gardening type of agricultural activities that are not too <br /> reliant on extensive soil - like fruit trees and ornamental plants. <br /> <br /> The applicant's intention is to subdivide the 14.989 acres of land into <br /> residential-agricultural lots. However, Chapter 205, Hawaii Revised Statutes, does not <br /> authorize residential dwellings as a permissible use in the Agricultural District unless <br /> the dwelling is related to an agricultural activity or is a "farm dwelling." Farm <br /> dwelling is defined in Section 205-4.5(a)(4), HRS, as "a single family dwelling located <br /> on and used in conjunction with a farm, including clusters of single-family farm <br /> dwellings permitted within agricultural parks developed by the State, or where <br /> agricultural activity provides income to the family occupying the dwelling." Thus, the <br /> requested boundary amendment would be in the direction of fulfilling the permissible <br /> uses of the rural designation. <br /> <br /> The proposed Rural boundary amendment would conform to the following goals <br /> and policies of the General Plan: <br /> <br /> LAND USE <br /> <br /> * Designate and allocate land uses in appropriate proportions and mix and in <br /> keeping with the social, cultural, and physical environments of the County. <br /> <br /> * Zone urban- and rural- types of uses in areas with ease of access to community <br /> services and employment centers and with adequate public utilities and <br /> facilities. <br /> <br /> * Promote and encourage the rehabilitation and use of urban and rural areas <br /> which are serviced by basic community facilities and utilities. <br /> <br /> * Allocate appropriate requested zoning in accordance with the existing or <br /> <br /> projected needs of neighborhood, community, region and County. <br /> <br /> * The county shall encourage the development and maintenance of communities <br /> meeting the needs of its residents in balance with the physical and social <br /> environment. <br />
