Modifying the Subdivision Processing Timetable (Condition C) <br /> "[consolidationlresubdivision plans shall be submitted within one year from the <br /> effective date of the change of zone. Final subdivision approval shall be <br /> secured within one year from the date of receipt of tentative subdivision <br /> approval.] Final Subdivision Approval of the proposed subdivision within the <br /> subject property shall be secured from the Plannine Director within five (51 <br /> years from the effective date of this amendment. <br /> Since 1990, the condition relative to performance on subdivisions has been <br /> modified to the suggested language. It is requested that this change be made <br /> to make the project consistent with current policy. <br /> C. Deleting Conditions D & E Relating to Permit and Construction Timetable <br /> At this time, the applicant plans to subdivide the property and sell the lots. A <br /> map of the proposed subdivision (reflecting the historical preserve areas) is <br /> attached as Eahibit 5. It has no plans to construct anything on the property. <br /> In that regard, the applicant would have no idea as to the construction <br /> timetable of the prospective landowner. As such, the applicant is requesting <br /> that these conditions be deleted. <br /> D. Other Conditions and Re-Letter Conditions Accordingly <br /> Further, inasmuch as Henry Street has already been constructed, the <br /> conditions relating to this Street (Conditions F and H) have essentially been <br /> fulfilled. As such, the applicant has no objections to the deletion of those <br /> conditions. <br /> 4. Annual Report Requirement <br /> Condition M required the submittal of an annual report. As noted above, no report <br /> has been filed since adoption of this rezoning ordinance. Accordingly, the applicant <br /> requests that this Requested Amendment and information contained herein be <br /> considered fulfillment (although belated) of this requirement. <br /> <br />
