Although Henry Street has been completed, no building permit has been <br /> issued for any portion of the site (Condition H). <br /> G. An archaeological data recovery and preservation plan (conditions I and J) <br /> was submitted to the State DLNR. It was approved on February 10, 1998, <br /> and WHAM, Inc, through its consulting archaeologist, Paul Rosendhal, Ph.D., <br /> Inc., is in the process of implementing the plan. (See Exhibit 4). <br /> It should also be noted that the applicant previously submitted a request to the <br /> Hawaii Island Burial Council seeking its approval to relocate the existing <br /> burials to one corner of the site. Based on the feedback from the Council, the <br /> applicant has elected to leave the burials "as is" with the appropriate buffers. <br /> A formal request of the Council will be made in the very near future. <br /> H. Since adoption of the rezoning ordinance, no annual report (Condition 1~ was <br /> filed by the landowners. As will be noted below, it is the intention of the <br /> applicant to have this submittal also satisfy -albeit belatedly -this <br /> requirement. <br /> 3. Nature and Justification of Requested Amendments <br /> In view of the foregoing, the applicant is requesting certain time extensions, as well as'. <br /> the modification and/or deletion of certain conditions which are no longer applicable. <br /> Using brackets [ ] to reflect items to be deleted and underscore _ to indicate items to <br /> be added, the specific requested changes are: <br /> A. Extending the Water Commitment Date (Condition B) <br /> "(B) the required water commitment payment shall be submitted to the <br /> Department of Water Supply in accordance with its 'Water Commitment <br /> Guidelines Policy' within ninety (90) days from the effective date of this <br /> amendment [ordinance]." <br /> In its efforts to fulfill other conditions of approval -conditions which affected <br /> the development schedule of this site -the applicant overlooked payment of <br /> the required fees. Fortunately, water is still available to this site, provided that <br /> the commitment and related fees are paid. <br /> <br />
