REPORT OF THE <br /> COMMITTEE ON PUBLIC WORKS AND PARKS <br /> DATE: August 5, 1997 RE: COMM. NO. 400 <br /> PLACE: Councilroom <br /> TIME: 9:11 a.m. <br /> Chairperson and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Pazks, to which was referred Communication No. 400, <br /> reports as follows: <br /> Communication No. 400 is a letter from Eric Weinert, dated July 15, 1997, which transmits a <br /> sign variance request on behalf of Hula Brothers, Inc. The request is for the purpose of allowing <br /> aground sign not to exceed 32 square feet in an agricultural zoned district. This would <br /> constitute a variance from the 8 square feet allowed for ground signs in agricultural districts in <br /> section 3-27 of the Hawaii County Code. <br /> The sign will be a 32 square foot ground sign upon which the words "Fresh Hawaiian Produce! <br /> Island FtuitslMon.-Fri. 11 am-Dusk Sat. 8-3" will be placed. The sign will be located at <br /> <br /> TMK 1-7-13:106. <br /> <br /> During its discussion, Your Committee considered a written statement from Mr. Wayne <br /> <br /> Onomura of the County of Hawaii's Department of Public Works' Building Division. In his <br /> <br /> statement, Communication No. 400.03, Mr. Onomura informed the Council that the Building <br /> <br /> Division did not object to this variance request. <br /> No testimony in opposition to the application was offered. <br /> Your Committee considered Mr. Weinert's written request that the Committee delay its <br /> discussion on this matter to enable him to attend the meeting and participate in the discussion. <br /> (See Communication No. 400.04.) However, because members of Your Committee felt that <br /> they had sufficient information about this application in front of them to consider approval of <br /> <br /> this variance request, they elected to proceed. <br /> In his application to the Council, Mr. Weinert stated that Hula Brothers needs to demonstrate the <br /> economic viability of their fruit stand business in order to obtain the financing to expand their <br /> operation. Your Committee found that a sign appropriate for a commercial establishment, i.e. <br /> 32 square feet (per section 3-29(a)(])), is necessary and appropriate given the speeds traveled <br /> and the lack of attractions along the Volcano Highway. Under the circumstances, Your <br /> Committee found that enforcement of the 8 square foot sign requirement would work a hardship <br /> <br /> upon the applicant. <br /> <br />
