NO. 121.10 ' <br /> <br /> PLACE: Councilroom <br /> <br /> TIME: 8:05 a m. <br /> Chair and Members <br /> Hawaii County Counci] <br /> Hilo, Hawaii 96720 <br /> Your Committee on Public Works and Parks, to which was referred Communication No. 121.10 <br /> and attached Resolution No. 77, reports as follows: <br /> The purpose of Resolution No. 77 is to fulfill the requirements of section 3 of Ordinance <br /> No. 96-51, with respect to the Kaapoko Sewer Extension, by approving this sewer extension by <br /> resolution. <br /> Pair Council Action on Kaapoko Sewer Extension <br /> The Council previously considered this matter during its deliberations upon Resolution No. 33. <br /> At the request of the Department of Public Works, Resolution No. 33 was referred directly to the <br /> full Council and was heard by this body on February 7, 1997. After a lengthy discussion, the <br /> Council deferred this matter until an opinion could be rendered by the Corporation Counsel's <br /> office as to the necessity of Council action on this proposed extension. This opinion, dated <br /> February 10, 1997 and numbered Communication No. 121.01, affirmed that Council approval <br /> was required for this sewer extension. Consequently, this matter was again considered by the <br /> Council on February 19, 1997 when it was filed. <br /> Present Council Action <br /> The Department of Public Works resubmitted this measure for the Council's consideration via <br /> Communication No. 121.10. This letter dated April 23, 1997, from Donna Fay K. Kiyosaki, <br /> Chief Engineer, transmitted Resolution No. 77 to the Council for its consideration. <br /> Communication No. 121.10 also transmitted tables which summarized flow rates and <br /> compliance percentages and a letter from Linda Reeves of the EPA. <br /> Ms. Kiyosaki and Mr. Peter Boucher, Wastewater Division Chief, testified in support of <br /> Resolution No. 77. <br /> <br />
