REPORT OF THE <br /> COMMITTEE ON PLANNING <br /> DATE: September I, 1998 Re: C-873/Bill No. 256 <br /> PLACE: Councilroom <br /> TIME: 1:45 p.m. <br /> Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> Your Committee on Planning, to which was referred Bill No. 256, transmitted by <br /> Mayor Stephen K. Yamashiro per Communication No. 873, dated May 29, 1998, regarding the <br /> request to amend Condition B of Ordinance No. 90-144 by Wainaku Congregation of <br /> <br /> Jehovah's Witnesses at Paukaa, South Hilo, Hawaii, TMK: 2-7-38:3, reports as follows: <br /> Bill No. 256 amends Ordinance No. 90-144, which reclassified 7.184 acres of land from <br /> Agricultural (A-20a) to Agricultural (A-3a), by amending Condition B to include a time <br /> extension of five years to secure Final Subdivision Approval. <br /> The applicant had initially submitted a Subdivision Application (91-] 68) on October 23, 1991, <br /> within the one-year time frame called for by Ordinance 90-144. Tentative Approval was granted <br /> on May 23, 1992, and Final Subdivision Approval was supposed to have been issued prior to <br /> May 23. 1993. The applicant's failure to obtain Final Subdivision Approval by May 23, 1993 <br /> <br /> resulted in the Subdivision Application 91-168 being declared null and void on February 9, 1994. <br /> The Planning Commission, at its .Ianuary 26, 1995 meeting, recommended approval of the <br /> applicant's request to amend Condition B of Ordinance No. 90-144 to allow for an extension of <br /> time to resubmit the Subdivision Application and subsequently to secure Final Subdivision <br /> Approval. Bill No. 52 was submitted to the Committee on Planning in March 1995, however, no <br /> action was taken. Atter reviewing this previously deferred bill at the July 1, 1997 Planning <br /> Committee meeting, Bill No. 52 and related communications were referred back to the Planning <br /> Department to amend the title and content, to request updated agency information and comments, <br /> and to have the Planning Commission review the application again. <br /> The Planning Commission submitted replacement Bill No. 256 on May 29, 1998 and Your <br /> Committee recommended to close file on Bill No. 52 on June 15, 1998. <br /> Bill No. 256 appeared on the June 15, 1998 Planning Committee agenda and was deferred until <br /> the June 3Q 1998 meeting, so Councilmember Dominic Yagong could obtain the input of the <br /> Paukaa Community Association in regard to this bill. Because Councilmember Yagong needed <br /> more time to receive input fi~om the Paukaa Community, Bilf No. 256 was not agendized until <br /> the August 18, 1998 Planning Committee meeting. At the August 18, 1998 meeting, <br /> Councilmember Yagong mentioned that he needed more information on the flood study from the <br /> Department of Public Works, so Bill No. 256 was deferred to the September I, 1998 meeting. <br /> PC-143 <br /> <br />
