(10) Grading, grubbing or stockpiling work wholly regulated by any of the following <br />permits: Stream channel alteration permit; Department of the Army permit; <br />permit to work within State Highway or County right-of-ways; and well drilling <br />permits. <br />(11) Grubbing of trails for survey lines and access for soil exploration equipment. <br />Article 2. Permits. <br />Section 10-7. Required. <br />Except as excluded in section 10-6: <br />(a) No grading work shall be commenced or performed without a grading permit. <br />(b) No grubbing work shall be commenced or performed without a grubbing permit except <br />where grubbing concerns land for which a grading permit has been issued. <br />(c) No stockpiling work shall be commenced or performed without a stockpiling permit, <br />except where stockpiling is on land for,.which a grading permit has been issued and <br />stockpiling areas are shown on the approved grading plan. <br />Section 10-8. Application. <br />(a) An applicant for a grading, grubbing, or stockpiling permit shall first file an application <br />on a form furnished by the County department of public works. An application may be <br />made on behalf of the prospective permittee by its contractor or other authorized agent. <br />Each application shall: <br />(1) Describe by tax map key number or street address the land on which the proposed <br />work is to be done; <br />(2) State the estimated dates for the starting and completion of the proposed work; <br />and <br />(3) Show the name of the permittee, owner, engineer, surveyor or other person <br />preparing the plans as may be applicable, and contractor. <br />(4) Be reviewed and approved by the State of Hawaii Historic Preservation Division <br />for compliance with chapter 6E, Hawai`i Revised Statutes, and other applicable <br />regulations and laws. <br />(5) Be reviewed and approved by the County of Hawaii planning department for <br />compliance with the County general plan and applicable land use regulations and <br />laws. No approval will be granted unless the director of the planning department <br />determines that: <br />(A) The proposed work implements a legal use of the property; or <br />(B) Is an approved remedial action. <br />(b) Each application for a grading permit shall also be accompanied by three sets of plans <br />and specifications prepared by an engineer or land surveyor licensed in the State of <br />Hawaii, including: <br />(1) For all areas: <br />(A) A vicinity sketch or other data adequately indicating the site location; <br />(B) Boundary lines of the property on which the work is to be performed; <br />M <br />
