No. 1503/Res. 775-08 <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 =~ <br />Your Committee on Public Works and Intergovernmental Relations, to which was referred <br />Communication No. 1503, regarding Resolution 775-08, reports as follows: , <br />Resolution 775-08, transmitted by Assistant Corporation Counsel Gerald Takase via <br />Communication No. 1503, dated October 6, 2008. This proposed resolution authorizing the <br />abandonment and sale of that certain road remnant fronting Oshima Store, situate at Kainaliu, i <br />North Kona, County and State of Hawaii, to CEOK LLC, an area of 714 square feet, identified!. <br />as Tax Map Key: (3)7-9-007:038. <br />There was no testimony from members of the public regarding the proposed acceptance. <br />Assistant Corporation Counsel Gerald Takase appeared before your committee. Mr. Takase <br />confirmed the realignment of Mamalahoa Highway through Kainaliu Village in North Kona, <br />Hawaii, created a remnant fronting the Oshima store property owned by CEOK LLC, who <br />has expressed a desire to acquire this remnant. This will allow Oshima to expand its store <br />towards the street by about seven feet, bringing the storefront even with others along Mamalahoa <br />Highway in Kainaliu. , <br />Pursuant to section 2-110, Hawaii County Code; this roadway is economically and physically ' <br />unsuitable or undesirable for development or utilization as a separate unit by reason of its <br />location, size and shape, and is hereby declared a remnant; pursuant to sections 2-] 71 and 2-118, <br />the Council may direct the Director of Public Works to dispose of real property without recourse <br />to public auction and shall first be offered for sale to the abutting landowner, CEOK LLC, <br />subject to the following: 1) buyer to pay all cost of surveying, and subdivision; and 2) buyer to'. <br />consolidate remnant with its property within one year. <br />Public Works Director Bruce McClure and Traffic Division Chief Ron Thiel appeared before <br />your Committee. Mr. McClure and Mr. Thiel commented on the removal of the diagonal <br />parking spaces fronting Oshima store in addition to other improvements including a loading zone <br />and parallel parking spaces. <br />PWIRC RPT NO. 100 <br />
