The zone request is consistent with the General Plan's Land Use Pattern <br /> Allocation Guide (LUPAG) Map which designates the azea as Extensive <br /> Agricultural and Orchards. <br /> 3. All essential services and utilities, including water, wastewater and roadways will <br /> be provided. <br /> Public testimony from adjacent landowners east of the subject property expressed concerns <br /> relating to the 4-acre discrepancy in land area of the subject property which does not match the <br /> land area shown on the tax maps. Concerns were also expressed relating to the existing family <br /> cemetery on the subject property which was established in the eazly 1800's and traffic and water <br /> improvements. <br /> In response to the concerns, the applicants stated that the subject property was purchased via a <br /> Partition Action in the Third Circuit Court with full knowledge that the land area was based on a <br /> very old survey with no warranty from the Commissioner as to its exact size. After the sale was <br /> confirmed, the applicants had a survey made by Imata & Associates, Inc. to determine the true <br /> land area. <br /> Your Committee amended Condition C of Bill No. 15 to clarify off-site water system <br /> improvements, added a standard compliance with affected agencies condition, and added other <br /> language used consistently in similar zoning bills. <br /> Your Committee also requested that a proposed draft be considered at the bill's first reading <br /> <br /> which includes the standard fair share condition and a condition prohibiting ohana and <br /> <br /> condominium property regimes (CPR). The applicants agreed to all of the conditions for <br /> <br /> approval but felt that in the event that they may not be unable to meet all of the zoning <br /> <br /> requirements, other alternatives would need to be considered. <br /> It was noted by Your Committee that ohana dwellings are not permitted on agricultural lots and <br /> <br /> reference should be made in regards to farm dwellings. <br /> PC REPORT NO.: 18 <br /> <br />
