5/97 Contract No. HA-98/99-2(A) <br /> #2 <br /> AGREEMENT FOR GRANTS AND PURCHASES OF SERVICE <br /> THIS AGREEMENT. effective the.t day of July 1997, is entered into <br /> between the Executive Office on Aging, State of Hawaii (hereinafter "STATE"), by its Director <br /> (hereinafter "DIRECTOR"), and the Hawaii County.by and through its County Council and Its <br /> Mayor (hereinafter "CONTRACTOR"). whose business address is do Hawaii County Office of <br /> Aging, 101 Aupuni Street. Room 342, Hawaii 96720, <br /> RECITALS <br /> WHEREAS, Chapter 42D, Hawaii Revised Statute establishes the qualifying <br /> standards and conditions relating to the receipt of funds contained in this chapter and under <br /> section 42D-11(b) provides that the Standards and Conditions shall not apply to funds that are <br /> transferred from one governmental agency to another governmental agency, including county <br /> agencies; provided that, it the receiving agency in turn contracts with a recipient or provider,then <br /> the qualifying standards and conditions and other provisions of this chapter shall apply to the <br /> recipient or provider and the contract. The receiving agency shall ensure compliance by the <br /> recipient or provider. <br /> WHEREAS, the STATE, pursuant to Chapter 349, Hawaii Revised Statutes, is <br /> mandated to develop and implement health, education, recreational and cultural programs for <br /> elderly persons; and to develop and implement active programs of consumer protection and pre- <br /> retirement counseling; and to provide technical assistance and liaison for the purpose of <br />
