<br />i( --.....,. <br /> <br />. <br /> <br />. <br /> <br />,-. , <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO. 141 97 <br />(DRAFT 2) <br />AUTHORIZATION FOR COUNTY OF HAWAII TO PARTICIPATE IN THE <br />DEMONSTRATION PAPAYA QUARANTINE PROGRAM. <br /> <br />WHEREAS, the State Department of Agriculture ("DOA"), the College of Tropical Agriculture <br />and Human Resources ("CT AHR") and Research Corporation of the University of Hawaii <br />("RCUH") desire to implement a demonstration quarantine program in Puna, Hawaii, and has <br />invited the County of Hawaii to be a participant; and <br /> <br />WHEREAS, the role of the County of Hawaii will be to lease lands from Kamehameha Schools <br />Bishop Estate for purposes of allowing permittees to plant papaya pursuant to pre-approved crop <br />development plans and to implement disease control measures; and <br /> <br />WHEREAS, DOA and the Papaya Administrative Committee, with County observing, will select <br />and assist in assigning lands to permittees in a fair and impartial manner; and <br /> <br />WHEREAS, DOA, with CT AHR assisting, will develop project management protocols and <br />implement the demonstration "Quarantine Program" project in accordance with conditions <br />contained in the management protocols; and <br /> <br />WHEREAS, RCUH will act as the fiscal agent for the County and will be responsible to the <br />County for collection of rents, disbursement of project expenses and accountability of all project <br />income and expenses; and <br /> <br />WHEREAS, RCUH, in its capacity as fiscal agent for the County, shall be responsible for le~se <br />payments to Kamehameha Schools Bishop Estate under the terms of the County of Hawaii's <br />lease agreement with Kamehameha Schools Bishop Estate; and <br /> <br />WHEREAS, pursuant to Section 46-7, Hawaii Revised Statutes, the County, with the consent of <br />the Council, may enter into agreements with any public bodies respecting action to be taken to <br />furnish, expend and receive funds or other assistance in connection with projects to be <br />undertaken; and <br /> <br />WHEREAS, pursuant to Section 10-11, Hawaii County Charter, any contract, lease or other <br />obligation requiring the payment of funds from the appropriation of more than one fiscal year <br />shall be approved by resolution. <br />
