<br />.. ,,- <br /> <br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />RESOLUTION NO.~ <br /> <br />RESOLUTION AUTHORIZING THE ABANDONMENT AND QUITCLAIM OF <br />PAHOA-KALAPANA ROAD REMNANT TO THE STATE OF HAWAII, TAX MAP <br />KEY NOS. (3)1-2-06:033 AND 081. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> <br />WHEREAS, the County of Hawaii owns and maintains a portion of the old <br />Pahoa-Kalapana Road in the land of Kaimu, Puna, beginning at the south boundary of <br />General Lease 5531 to Kalapana Ohana Association, identified on the tax map as Tax <br />Map Key No. (3)1-2-06:081, in a northerly direction for a distance of approximately 900 <br />feet, to the Kaimu-Pahoa Road, FASP No. S-0130(11), as shown on the attached <br />Exhibit "A". and <br />, <br /> <br />WHEREAS, the roadway only serves the parcel leased by the Kalapana Ohana <br />Association from the State of Hawaii, and there exists no need for the County of Hawaii <br />to continue to maintain that portion of the roadway; and <br /> <br />WHEREAS, it is in the County of Hawaii's best interest and the best interest of the <br />Kalapana Ohana Association and the State of Hawaii that this roadway be abandoned and <br />quitclaimed to the State of Hawaii, who is the adjoining landowner; and <br /> <br />WHEREAS, all County highways once established, continue until vacated, closed, <br />abandoned or discontinued by resolution of the Council; and <br /> <br />WHEREAS, Sections 2-118 and 2-120 of the Hawaii County Code authorize the <br />disposal of remnant roadways by sale, exchange and/or lease to governmental agencies; <br />and <br /> <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE <br />COUNTY OF HAWAII, that the portion of the old Pahoa-Kalapana Road in the land of <br />Kaimu, Puna, beginning at the south boundary of General Lease 5531 to Kalapana Ohana <br />Association, identified on the tax map as Tax Map Key No. (3)1-2-06:081, in a northerly <br />direction for a distance of approximately 900 feet, to the Kaimu-Pahoa Road, F ASP <br />No. 8-0130(11), is hereby abandoned and discontinued as a County highway and is <br />quitclaimed to the State of Hawaii. <br />
