<br />-, <br /> <br />. <br /> <br />. <br /> <br />COUNTY OF HAWAII <br /> <br />STATE OF HAWAII <br /> <br />BILL NO. 25 <br />(DRAFT 2) <br /> <br />ORDINANCE NO. <br /> <br />97 26 <br /> <br />AN ORDINANCE TO AMEND THE HAWAII COUNTY CODE 1983 (1995 EDITION) <br />RELATING TO THE BUILDING CODE. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAW All: <br /> <br />SECTION 1. Section 5-2.2.1 of the Hawaii County Code 1983 (1995 Edition) is hereby <br />amended to read as follows: <br /> <br />"Section 5-2.2.1. Applicability of code. <br />This Code sets forth design requirements for the efficient use of energy in new <br />buildings and new construction in existing buildings as further defined in this Code. <br />This Code applies to buildings or portions of buildings that provide facilities or shelter <br />for human occupancy. Included are shell buildings, speculative buildings and <br />warehouses, or portions thereof, that are converted to use as facilities or shelter for <br />human occupancy. The requirements apply to building envelope; distribution of <br />energy; and systems and equipment for ventilating, air conditioning, service water <br />heating, lighting, and energy managing." <br /> <br />SECTION 2. Section 5-2.2.2 of the Hawaii County Code 1983 (1995 Edition) is hereby <br />amended to read as follows: <br /> <br />"Section 5-2.2.2. When code not applicable. <br />This Code does not apply to: <br />(a) Areas of buildings intended primarily for manufacturing or for commercial or <br />industrial processing; <br />(b) Buildings or separately enclosed identifiable areas having any combination of <br />dedicated space heating, service water heating, ventilating, air-conditioning and <br />lighting systems whose combined peak design rate of nonrenewable energy <br />usage for these purposes is less than 1.0 wattl ft2 or 3.413 Btu/h-ft2 of gross <br />floor area. Site generated wind, hydro or solar electric power are exempt; [and] <br />(c) Buildings of fewer than one hundred square feet of gross floor area; and <br />(d) Moved buildings and factory built structures." <br /> <br />SECTION 3. Section 5-2.3.1 of the Hawaii County Code 1983 (1995 Edition) is hereby <br />amended by adding the following definitions to read as follows and to be placed in <br />their appropriate order: <br />'''Factory built structure' means any structure which is fabricated or assembled at <br />a place other than the building site." <br />IIIService establishment' means a retail-like facility including watch repair, real <br />estate office, auto and tire service facIlities, parts departments, travel agencies, and <br />similar facilities in which the customer obtains services rather than the direct selection <br />of goods." <br />
