COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAII <br />167 09 <br />RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF A LATER FISCAL YEAR AND OF <br />MORE THAN ONE FISCAL YEAR FOR ONE (1) LANDFILL COMPACTOR <br />WHEREAS, Section 10-11 of the County Charter requires that any contract, lease or other obligation <br />requiring payment of funds from the appropriations of a later fiscal year or more than one fiscal year be <br />approved by resolution; and <br />WHEREAS, the West Hawaii landfill current operations has one landfill compactor to compact the trash <br />to save airspace, thereby allowing more trash to be buried and to also be in compliance with the State <br />Department of Health regulations; and <br />WHEREAS, having a second compactor on site will ensure compaction continues if the other compactor <br />is down for repairs or maintenance; and <br />WHEREAS, the County wishes to enter into a five (5) year contract to lease with purchase options for <br />one (1) landfill compactor for solid waste operations at the West Hawaii landfill. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br />Mayor is hereby authorized to enter into a five (5) year lease agreement with purchase options for the <br />acquisition of one (1) landfill compactor for solid waste operations at the West Hawaii landfill and that sufficient <br />funds be budgeted in future fiscal years to cover the anticipated obligations of the County under the terms of the <br />agreement. <br />BE IT FURTHER RESOLVED that the Clerk transmit copies of this resolution to the Mayor's Office and <br />the Departments of Finance and Environmental Management. <br />Dated at Hilo ,Hawaii, this 2nd day of June , 2009. <br />INTRODUCED BY: <br />COUNCIL MEMBER, CO N F HAWAII <br />COUNTY COUNCIL <br />County of Hawaii <br />Hilo, Hawaii <br />1 hereby certify that the foregoing RESOLUTION was by the <br />vote indicated to the right hereof adopted by the COUNCIL of the <br />County of Hawaii on June 2, 2009 <br />ATTEST <br />x'~Y_f- _zti-rte+ <br />COUNTY CLERK CHAIRPERSON & PRESIDING OFFICER <br />ROLL CALL VOTE <br /> AYES NOES ABS EX <br />ENRIQUES X <br />FORD X <br />GREENWELL }{ <br />HOPFMANN X <br />IKEDA X <br />NAEOLE X <br />ONISH] X <br />YAGONG g <br />YOSHIMOTO g <br /> 9 0 0 0 <br />Reference C-336/FC-65 <br />RESOLUTION NO. ~`6~ 09 <br />
