MEMORANDUM OF AGREEMENT
<br />BETWEEN
<br />OFFICE OF HAWAIIAN AFFAIRS AND THE HAWAII COUNTY POLICE DEPARTMENT
<br />This Memorandum of Agreement (hereinafter "MOA") is entered into this day of
<br />2009, by and between the OFFICE OF HAWAIIAN AFFAIRS, a body corporate
<br />existing under the Constitution and the Laws of the State of Hawaii, by its Administrator, Clyde
<br />W. Namu'o, and its Deputy Administrator, Mona Beruazdino, respectively, acting by and on
<br />behalf of the Board of Trustees, whose address is 711 Kapi'olani Boulevard, Suite 500,
<br />Honolulu, Hawaii, 96813, hereinafter referred to as "OHA" 'and the HAWAII POLICE
<br />DEPARTMENT, County of Hawaii, acting by and through its Mayor, William P. Kenoi, whose
<br />business and mailing address is 349 Kapi'olani Street, Hilo, Hawaii 96720, hereinafter referred
<br />to as "HCPD".
<br />WITNESSETH:
<br />WHEREAS, one of the purposes for which OHA was established is to better the
<br />conditions of native Hawaiians and Hawaiians as defined in HRS sections 10-2, 10-4(4), 10-4(6)
<br />and 10-4(8), and other applicable law(s), as amended; and
<br />WHEREAS, Native Hawaiians comprises about twenty percent (20%) of the State of
<br />Hawai'i's total population, yet thirty-nine percent (39%) of Hawaians inmates identify
<br />themselves as part-Hawaiian or Native Hawaiian; and
<br />WHEREAS, there are approximately forty percent (40%) Native Hawaiian parolees
<br />statewide who are at risk of being re-arrested and returning to prison; and
<br />WHEREAS, many Native Hawaiian youths have their criminal cases end in adjudication
<br />compazed to other ethnic groups; and
<br />WHEREAS, sixty-four percent (64%) of those youth defendants aze Native Hawaiian,
<br />and they comprise over fifty percent (50%) of the population at the Hawaii Youth Correctional
<br />Facility; and
<br />WHEREAS, the OHA and HCPD desire to work cooperatively and collaboratively to
<br />train and educate HCPD Patrol Officers in the areas of cultural awareness, crisis intervention,
<br />homelessness, and mental illness so they may assist individuals in need; and
<br />WHEREAS, on November 2, 2006, the OHA Boazd of Trustees appropriated funds and
<br />authorized the Administrator to commit up to TWENTY-FIVE and NO/100 DOLLARS
<br />($25,000) to provide the necessary training and education in such areas as cultural awareness,
<br />crisis intervention, homelessness, and mental illness; and
<br />WHEREAS, the HCPD represents that it has the requisite qualifications, expertise,
<br />experience, and capacity to comply with terms and conditions required under this MOA; and
