COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 191 09 <br />RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO COMPROMISE A CLAIM <br />FOR SURPLUS FUNDS IN ACCORDANCE WITH SECTION 19-3(12), HAWAII COUNTY <br />CODE. <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br />WHEREAS, Remar Sylvester has made claims for the surplus funds from the sale of his <br />father's properties that were sold by the County of Hawaii at its tax sale in December 1989; and <br />WHEREAS, while his mother did receive notices of the tax sale and notices to claim the <br />surplus, she understands no English and did not attempt to have the notices translated; and <br />WHEREAS, due to these unfortunate circumstances, the family not only lost the three parcels <br />that the father had owned, but the surplus funds went unclaimed, until now, when the family finally <br />learned what has happened to the parcels; and <br />WHEREAS, while the parcels cannot be returned to the family, the Director of Finance needs <br />Council approval in order to recognize these claims for surplus funds, due to the length of time <br />involved, pursuant to Section 19-3(12), Hawaii County Code. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br />HAWAII that it hereby authorizes the Director of Finance to compromise and settle the claims of the <br />Remar Sylvester family and pay the surplus fund claims. <br />
