No. 287/Res No. 127-09 <br /> PLACE: Sheraton Keauhou Bay Resort & Spa <br /> 78-128 Ehukai Street <br /> Kailua-Kona, Hawaii <br /> TIME: 1:30 p.m. <br /> <br /> Council Chair and Members <br /> Hawaii County Council <br /> Hilo, Hawaii 96720 <br /> <br /> Your Committee on Planning, to which was referred Communication No. 287, reports as <br /> follows: <br /> <br /> Communication No. 287, transmitted by Planning Director BJ Leithead Todd, dated <br /> April 21, 2009 presents a resolution for approval of an In Lieu Fair Share contribution by Kohala <br /> Ranch, LLC, in the amount of $16,191.99. This amount will be used towards the purchase of a <br /> new fire truck to support fire protection functions, as required by Condition R(a) of Ordinance <br /> 92-40. <br /> <br /> The payment and delivery of the fire truck are scheduled for early June. The balance of the <br /> $159,000 purchase price for the fire truck was raised by the Kohala Ranch Community <br /> Association ("KRCA"). Kohala Ranch, LLC requested that it receive 33 single-family dwelling <br /> credits against any future fair share contributions that it may be responsible for. These credits <br /> may be used to satisfy any existing or future fire fair share requirements within the North Kohala <br /> district. Furthermore, should the County adopt an impact fee ordinance, these credits may be <br /> used to satisfy fire impact fee requirements for 33 single-family residential units or its <br /> equivalent. <br /> <br /> Planning Committee Chair Donald Ikeda introduced an amendment to Resolution No 127-09, <br /> correcting formatting errors and to include language regarding the 33 unit credit. Council <br /> Member Brenda Ford requested confirmation from Fire Chief Darryl Oliveira that the new fire <br /> truck would be housed in Kohala. Council Member Ford stated that she did not want to get a <br /> second-hand fire truck from Hilo. Chief Oliveira stated that the fire truck will be housed in <br /> Kohala. All nine members of the Committee voted in favor of amending Resolution 127-09 with <br /> the amendments contained in Communication 287.1 <br /> <br /> Your Committee concurs with the Planning Director's proposed Resolution 127-09, as amended <br /> by Communication 287.1. <br /> <br /> <br /> <br /> <br /> <br /> <br /> PC Report 28 <br />
