<br />COUNTY OF HA W AI'I <br /> <br /> <br />STATE OF HAWAI'I <br /> <br />BILL NO. <br /> <br />71 <br /> <br />ORDINANCE NO. <br /> <br />09 73 <br /> <br />AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 4 OF THE HAW AI'I COUNTY <br />CODE 1983 (2005 EDITION AS AMENDED), VEHICLES AND TRAFFIC, RELATING TO <br />FEES. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAW AI'I: <br /> <br />SECTION 1. Purpose. The purpose of this measure is to change penalties for <br /> <br />delinquency from a percentage calculation to a flat fee. This will simplify penalty calculation for <br /> <br />the public and for County staff, and will be consistent with the method for charging similar <br /> <br />penalties in the other counties. <br /> <br />SECTION 2. Section 24-18, Hawai'i County Code 1983 (2005 edition) is amended to <br /> <br />read as follows: <br /> <br />"Section 24-18. Motor vehicle tax; minimum tax; penalties for <br />delinquency. <br /> <br />(a) The minimum tax assessed under section 24-17 shall in no case be <br />less than $6. <br />(b) Effective [January 1, 1982] July 1. 2009. any vehicle weight tax <br />imposed by section 24-17 for any year and not paid when due, <br />shall become delinquent and a penalty of [ten percent] $8 for <br />vehicles taxed at the passenger car rate and $20 for vehicles taxed <br />at the commercial vehicle rate shall be added to, and become a part <br />of, the tax collected." <br /> <br />SECTION 3. Material to be repealed is bracketed and stricken. New material is <br /> <br />underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br /> <br />underscoring need not be included. <br />
