4) Lot B-1 (3,950 sq. ft.) will be conveyed to the County by Pang-Ching (outlined in orange on Exhibit "B" attached hereto. 5) Parcel (3,950 sq. ft.) will be conveyed to Pang-Ching by the County (outlined in blue on Exhibit "B" attached hereto. WHEREAS, the abandonment and exchange is advantageous to the County of Hawaii in that it provides the only viable solution to repairing the damage; and WHEREAS, Section 2-111 of the Hawaii County Code permits the exchange of real property for private property, and Section 2-118, Hawaii County Code, allows for the disposal of remnant parcels. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the right-of-way designated as Road Remnant "R" outlined in yellow on the attached map hereto as Exhibit "A" is hereby abandoned and discontinued as a County road. BE IT FURTHER RESOLVED that in accordance with Sections 2-111 and 2-118, Hawaii County Code, authorizes the exchange as follows: 1) Lot A-1 (12,849 sq. ft.) will be conveyed to the County by the Ojiris (outlined in pink of Exhibit "B" attached hereto. 2) Easement A-2 (1,756 sq. ft.) for access and utility purposes will be acquired by the County from the Ojiris (cross-hatched in green on Exhibit "B" attached hereto. 3) Parcel (13,862 sq. ft.) will be conveyed to the Ojiris by the County (outlined in green on Exhibit "B" attached hereto. 4) Lot B-1 (3,950 sq. ft.) will be conveyed to the County by Pang-Ching (outlined in orange on Exhibit "B" attached hereto. 5) Parcel (3,950 sq. ft.) will be conveyed to Pang-Ching by the County (outlined in blue on Exhibit "B" attached hereto. BE IT FURTHER RESOLVED that the Clerk of the County of Hawaii is directed to transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of Hawaii; (2) Warren H.W. Lee, Director of Public Works; (3) Deputy Corporation Counsel
