c. The right to assign in whole or in part the rights reserved <br />to the Grantor, subject to the non-exclusive easement granted pursuant <br />to this grant ofnon-exclusive easement; <br />d. The right to suspend or restrict access to and use of the <br />easement area if it is necessary to do so, upon immediate notice to the <br />Grantee, for construction, maintenance, repair, health or safety <br />reasons, or if so required by a court order or by any other act of any <br />federal, state or county body or agency; <br />e. The Grantor's and its contractors, employees, agents, <br />invitees and guests' use of the easement area on terms that are <br />different from those set forth in this grant ofnon-exclusive easement; <br />f. Rights and privileges of Hokuli`a lot owners, their <br />guests, invitees and contractors' use of the easement area on terms <br />that are different from those set forth in this grant ofnon-exclusive <br />easement. <br />g. Rights and privileges of other authorized persons' use of <br />the easement area on terms that are different from those set forth in <br />this grant ofnon-exclusive easement. <br />In their exercise of these reserved rights, the Grantor and other <br />persons having the reserved right to use the easement area shall make all <br />reasonable efforts to avoid interfering with the Grantee's right to allow the <br />general motoring public to use the easement area under the provisions of this <br />grant of non-exclusive easement. <br />7. Existing Condition of Easement Area, Acceptance, <br />Assumption ofRisk. The Grantor designed and constructed the Mamalahoa <br />Bypass Highway arid Haleki`i Street Extension pursuant to standards <br />established and approved by the Grantee, but as of the date of this grant of <br />11 <br />
