disturbance to the easement area which will be restored to its original <br />condition, less reasonable wear and tear, or such other condition as the <br />Grantor and the Grantee shall mutually agree upon in writing, and within a <br />reasonable time after removal. <br />11. Removal o~Eguipment and Materials for Permitted <br />Work. Upon completion of any permitted work performed in or upon the <br />easement area, the Grantee will remove therefrom all equipment and unused <br />or surplus materials, if any, and will leave the easement area in a clean and <br />sanitary condition satisfactory to the Grantor. <br />12. Maintenance. In addition to any other provision of this <br />grant ofnon-exclusive easement, including Exhibit "C" attached hereto, the <br />Grantee will at all times keep the easement area and the improvements, <br />equipment, appliances, devices and other property thereon in a clean and <br />safe condition and in a safe and proper operating condition and, further, will <br />not make, permit or suffer, any waste, strip, spoil, nuisance, danger, risk, <br />hazard or unlawful, improper, or offensive use of the easement area or allow <br />conditions to arise or to exist on the easement area that may cause the <br />easement area to present dangers, risks or hazards to the safety of persons <br />and their property who are authorized to use the easement area. The Grantor <br />and the Grantee shall work cooperatively to determine a maintenance and <br />inspection schedule to facilitate the execution of this paragraph. <br />13. Non-Discriminatory Practices. The Grantee covenants <br />that the use and enjoyment of the easement area will not be in support of any <br />policy which discriminates against anyone based upon race, creed, sex, <br />color, national origin, religion, marital status, familial status, ancestry, <br />physical handicap, disability, age or HIV (human immunodeficiency virus) <br />infection. <br />l q. <br />
