Solid waste will be <br />disposed of by commercial haulers or individual homeowners into an approved landfill. <br />Electrical and telephone services are available to the site. Police services are located <br />about 4 miles away in downtown Hilo and fire services area located within 2 miles of the <br />property on Kawai 1 ani Street. Medical services are available in Hilo. To limit the <br />cumulative impact of the proposed subdivision on area infrastructure, a condition of <br />approval will prohibit a second dwelling and condominium property regime on each lot. <br /> <br />The request is not contrary to Chapter 20SA, Hawai'i Revised Statutes, <br />relating to Coastal Zone Management Area. The subject property is located over four <br />miles from the shoreline and is not in the Special Management Area. Thus, the property <br />will not be affected by coastal hazards and beach erosion. There are no identified <br />recreational resources, public access to the shoreline or mountain areas, scenic and open <br />space preserves, coastal ecosystems, marine resources or other natural and environmental <br />resources on the subject property. <br /> <br />In view of the Hawai'i State Supreme Court's "PASH" and "Ka Pa 'akai 0 <br />Ka 'Aina " decisions, the issue relative to native Hawaiian gathering and fishing rights <br />must be addressed in terms of the cultural, historical, and natural resources and the <br />associated traditional and customary practices of the site: <br /> <br />. Investigation of valued resources: No formal archaeological reconnaissance <br />survey, oral history of kama 'a in a accounts of the area, historical survey of <br />documentary records, or botanical study was included in the application. <br />. The valued cultural, historical, and natural resources found in the rezoning area: <br />The property has been used for the cultivation of sugarcane in the past and is <br />currently used for residential purposes. As such, it is anticipated that no historic <br />properties will be affected. In a letter dated October 31, 2008, the State <br />Department of Land and Natural Resources Historic Preservation Division <br />(SHPD) stated that no historic properties will be affected by this undertaking <br />because intensive cultivation has altered the land. A condition of the change of <br />zone will require that the applicant cease work and notify the SHPD should any <br />unanticipated archaeological features or sites be uncovered during the course of <br />development. <br />. Possible adverse effect or impairment of valued resources: Native plants may be <br />destroyed by ground alteration. There is no evidence that the flora in the area are <br />particularly desired or used for cultural practices. <br />
