<br /> <br /> <br /> <br /> <br /> J~tv OF <br /> 4O •'~v \,1~J~•• <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> ~rE•oF•N~,N <br /> <br /> BILL NO. 116 <br /> <br /> <br /> ORDINANCE NO. 09 119 <br /> <br /> AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 7, DIVISION 8, OF THE HAWAII <br /> COUNTY CODE 1983 (2005 EDITION, AS AMENDED), VEHICLES AND TRAFFIC, <br /> RELATING TO MOPEDS <br /> <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> <br /> SECTION 1. Purpose. The purpose of this measure is to clarify the registration of <br /> <br /> mopeds and current Hawaii Revised Statutes requiring certificates of inspection for mopeds. <br /> <br /> SECTION 2. Chapter 24, article 7, division 8, section 24-186.1, Hawaii County <br /> Code.1983 (2005 edition, as amended), is amended to read as follows: <br /> <br /> "Section 24-1861. [°'-oteetive ° wear- ir°gulr-ed-.]Moped rules. <br /> No person shall: <br /> (1) Operate a moped on any highway or street in the County unless that person is <br /> properly wearing protective eyewear. <br /> (2) Offer for lease or rent a moped without providing to the operator protective <br /> eyewear. <br /> Every moped shall be certified pursuant to Hawaii Revised Statutes section 286-26, <br /> cert ificates of inspection prior to the issuance of a registration by the director of finance <br /> and prior to the transfer of any registration; provided that this requirement shall not apply <br /> to any subsequent transfer of registration in a moped that carries a current certificate of <br /> inspection." <br /> <br /> SECTION 3. Material to be repealed is bracketed and stricken. New material is <br /> <br /> underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br /> <br /> underscoring need not be included. <br /> <br /> SECTION 4. If any provision of this ordinance, or the application thereof to any person <br /> <br /> or circumstance is held invalid, such invalidity shall not affect other provisions or applications of <br /> <br /> the ordinance which can be given effect without the invalid provision or application, and to this <br /> <br /> end, the provisions of this ordinance are declared to be severable. <br />
