COUNTY OF HAWAII <br />STATE OF HAWAII <br />BILL NO. >>6 <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 7, DIVISION 8, OF THE HAWAII <br />COUNTY CODE 1983 (2005 EDITION, AS AMENDED), VEHICLES AND TRAFFIC, <br />RELATING TO MOPEDS <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br />SECTION 1. Purpose. The purpose of this measure is to clarify the registration of <br />mopeds and current Hawaii Revised Statutes requiring certificates of inspection for mopeds. <br />SECTION 2. Chapter 24, article 7, division 8, section 24-186.1, Hawaii County <br />Code 1983 (2005 edition, as amended), is amended to read as follows: <br />"Section 24-1861. ( .Moped rules. <br />~ No person shall: <br />(1) Operate a moped on any highway or street in the County unless that person is <br />properly wearing protective eyewear. <br />(2) Offer for lease or rent a moped without providing to the operator protective <br />eyewear. <br />Every moped shall be certified pursuant to Hawaii Revised Statutes section 286-26 <br />certificates of inspection prior to the issuance of a registration by the director of finance <br />and prior to the transfer of anv registration• provided that this requirement shall not apps <br />to anv subsequent transfer of registration in a moped that carries a current certificate of <br />inspection." <br />SECTION 3. Material Co be repealed is bracketed and stricken. New material is <br />widerscored. [n printing this ordinance, the brackets, bracketed and stricken material and <br />underscoring need not be included. <br />SECTION 4. If any provision of this ordinance, or the application thereof to any person <br />or circumstance is held invalid, such invalidity shall not affect other provisions or applications of <br />the ordinance which can be given effect without the invalid provision or application, and to this <br />end, the provisions of this ordinance are declared to be severable. <br />
