<br />COUNTY OF HAWAI'I STATE OF HAWAI'I <br /> <br /> <br />RESOLUTION NO. 266 09 <br /> <br />RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO <br />DISPOSE OF REAL PROPERTIES, TAX MAP KEYS (3)5-4-002-008 <br />(TANK SITE) AND (3)5-4-003-016 (CHLORINATOR SITE), TO THE <br />WATER BOARD OF THE COUNTY OF HAW AI'I. <br /> <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAW AI'I: <br /> <br />WHEREAS, the County ofHawai'i obtained a tank sIte (Tax Map Key (3)5-4-002-008) <br /> <br />("tank site"), as shown on Exhibit A attached hereto, and a chlorinator site (Tax Map <br /> <br />~ <br /> <br />Key (3 )5-4-003-0 16 ("chlorinator site"), as shown on Exhibit B attached hereto, located in <br /> <br />Hanaula, North Kohala, County and State of Hawai 'i, from Kohala Sugar Company in 1961; and <br /> <br />WHEREAS, the Department of Water Supply maintains the chlorinator site and tank site; <br /> <br />and <br /> <br />WHEREAS, the Water Board of the County ofHawai'i now owns the reservoir located <br /> <br />on Tax Map Key (3)5-4-002-022 ("reservoir site"), which is adjacent to the tank site, as shown <br /> <br />on Exhibit C attached hereto; and <br /> <br />WHEREAS, the Water Board of the County ofHawai'i desires to expand its existing <br /> <br />reservoir site and other water system facilitIes at this location, and plans to consolidate the tank <br /> <br />site with its newly acqUIred reservoir site; and <br /> <br />WHEREAS, Section 2-120, Hawai'i County Code, authorizes the disposal of real <br /> <br />property of the County, under such terms and conditIOns of sale that council deems proper, to the <br /> <br />Water Board of the County ofHawm'i as a governmental agency. <br />
