NO. <br /> <br /> <br /> 1 The department of business, economic development, and <br /> <br /> 2 tourism shall have sole jurisdiction over the ['ate <br /> 3 state planning under chapter <br /> <br /> 4 225M(-] and the Hawaii State Planning Act under chapter 226. <br /> <br /> 5 Due to the inherently interdependent functions of development, <br /> <br /> 6 planning, and land use, these functions shall not be transferred <br /> <br /> 7 by executive order, directive, or memorandum, to any other <br /> 8 department, nor shall these functions be subject to review or <br /> <br /> 9 approval by any other department." <br /> <br /> 10 SECTION 9. Section 201H-12, Hawaii Revised Statutes, is <br /> <br /> 11 amended by amending subsection (b) to read as follows: <br /> 12 11(b) The corporation may develop public land in an <br /> <br /> 13 agricultural district [eubjeet to the pier appreval e€-zee- and <br /> <br /> 14 use , when develeping lands gveater than fifteen aeres <br /> <br /> 15 in size,] and public land in a conservation district subject to <br /> 16 the prior approval of the board of land and natural resources. <br /> <br /> 17 The corporation shall not develop state monuments, historical <br /> <br /> 18 sites, or parks. When the corporation proposes to develop <br /> <br /> 19 public land, it shall file with the department of land and <br /> 20 natural resources a petition setting forth the purpose for the <br /> <br /> 21 development. The petition shall be conclusive proof that the <br /> <br /> 22 intended use is a public use superior to that which the land has <br /> <br /> 23 been appropriated." <br />
