<br />AN ORDINANCE AMENDING CHAPTER 18, ARTICLE 4, SUBSECTION 18-90(h), OF <br />THE HAWAI'I COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br />PUBLIC TRANSPORTATION. <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAW AI'I: <br /> <br />SECTION 1. Findings and Purpose. The Hawai'i County Council, in amending <br />Section 18-90(h), of the Hawai'i County Code 1983 (2005 edition, as amended), seeks to extend <br />the County-wide transportation k6kua zone to June 30, 2011. <br /> <br />SECTION 2. Chapter 18, article 4, section 18-90(h), of the Hawai'i County Code 1983 <br />(2005 edition, as amended), is hereby amended to read as follows: <br /> <br />(h) Island-wide transportation free zone. <br /> <br />(1) The purpose of this subsection is to provide the public with a <br />transportation alternative to the private automobile. The provision <br />of an effective public transportation system for the residents of the <br />County of Hawai'i will produce economic, social and lifestyle <br />benefits for the residents of Hawai'i County. The distances <br />residents must travel for work, medical, education, and social <br />needs will be alleviated by providing public transportation at no <br />cost to the user. <br />(2) The County of Hawai'i shall be designated a transportation k6kua <br />zone. Riders boarding and alighting any regularly scheduled bus <br />route operated by the County of Hawai 'i or its designee shall ride <br />free of charge. <br />(3) The transportation k6kua zone shall not apply to County contracted <br />shared-ride taxi services, County operated curb to curb van <br />services, or County operated non-scheduled bus services. <br />(4) The County wide transportation k6kua zone shall terminate on <br />[December 31, 2009.] June 30, 2011. <br />(5) Within one year of the k6kua zone's effective date, and again not <br />later than ninety days prior to [December 31, 2009,] June 30, <br />2011, the transit administrator shall report to the Hawai'i County <br />council on the impact of its implementation. <br /> <br />SECTION 3. Material to be repealed is bracketed and stricken. New material is <br />underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br />underscoring need not be included. <br /> <br />SECTION 4. If any provision ofthis ordinance, or the application thereof to any person <br />or circumstance, is held invalid, such invalidity shall not affect other provisions or applications <br />of the ordinance which can be given effect without the invalid provision or application, and to <br />this end, the provisions of this ordinance are declared to be severable. <br /> <br />SECTION 5. This ordinance shall take effect upon its approval. <br />
