FLAMMER III. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, WILLIAM H. FLAMMER III, TRUSTEE, is the owner of Lot 117, situate at <br /> `Ola`a, in the District of Puna, County and State of Hawai`i, identified as Tax Map <br /> Key: (3)1 -8- 005:125; and <br /> WHEREAS, the County of Hawaii owns and maintains North Pszyk Road; and <br /> WHEREAS, North Pszyk Road encroaches onto lands owned by William H. Flammer III, <br /> Trustee; and <br /> WHEREAS, William H. Flammer III, Trustee is presently in the process of subdividing out the <br /> encroachment (Lot 117 -A), more particularly described in Exhibit "A" and delineated on Exhibit "B" <br /> attached hereto, and is desirous of donating said Lot 117 -A to the County of Hawai`i; and <br /> WHEREAS, Article XIII, Section 13 -12 of the Hawaii County Charter, provides that the <br /> Council may accept gifts, which include the donation of land on behalf of the County of Hawaii. <br /> NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that in accordance with Article XIII, Section 13 -12 of the Hawaii County Charter, the <br /> County of Hawaii accepts the donation of Lot 117 -A, containing an area of 0.621 acre situate at <br /> `Ola`a, in the District of Puna, County and State of Hawai`i, identified as being a portion of Tax Map <br /> Key: (3)1 -8- 005:125, more particularly described in Exhibit "A" and delineated on Exhibit "B" <br /> attached hereto. <br /> BE IT FURTHER RESOLVED that a letter of appreciation be sent to William H. Flammer III, <br /> Trustee, P.O. Box 1060, Kula, Hawaii 96790. <br />
