No. 787 /Res. 329 -10 <br />Your Committee on Public Works and Intergovernmental Relations, to which was referred <br />Resolution 329 -10, reports as follows: <br />Resolution 329 -10, transmitted by Deputy Corporation Counsel Gerald Takase via <br />Communication 787, dated April 13, 2010, requests the Council's approval to accept the <br />donation of Lot 117 -A (encroachment), North Pszyk Road, Tax Map Key: (3) 1 -8- 005:125, from <br />William H. Flammer III. <br />Article XII, §13-12 of the Hawai`i County Charter provides that the Council may accept gifts, , <br />which include the dedication of land, on behalf of the County of Hawaii. <br />Council member Dominic Yagong asked Mr. Takase to explain the road conditions affecting the <br />parcel. The existing roadway encroaches into Mr. Flammer's private property, and this donation <br />includes a shoulder area.
