+ iv o ry <br /> COUNTY OF HAWAII •N/'•• s STATE OF HAWAII <br /> RESOLUTION NO. 331 10 <br /> A RESOLUTION TO STRONGLY URGE THE 2011 STATE LEGISLATURE TO <br /> PROHIBIT RIDING IN THE BACK OF OPEN BED PICKUP TRUCKS AND <br /> ENCOURAGE OUR FELLOW COUNTY COUNCILS TO JOIN THIS EFFORT. <br /> WHEREAS, safety dictates the use of seatbelts in automobiles; and <br /> WHEREAS, no seatbelts or other protection is available in the open bed of pickup <br /> trucks; and <br /> WHEREAS, potentially severe injury or death can and in fact has occurred in accidents <br /> involving passengers riding in the open bed of pickup trucks; and <br /> WHEREAS, perhaps 25 percent of the vehicles on our roads are pickup trucks; and <br /> WHEREAS, Hawai`i Revised Statutes, section 291 -14, prohibits, with certain <br /> exceptions, any person 12 years of age or under from riding in an open bed of a pickup truck; <br /> now, therefore, <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it <br /> strongly urges the 2011 State Legislature to prohibit any person from travelling or riding in the <br /> open bed of a pickup truck on any public highway or road. <br /> BE IT FURTHER RESOLVED that the Hawai`i County Council asks the county <br /> councils of Kaua`i, Maui, and the City and County of Honolulu to provide similar resolutions to <br /> the 2011 State Legislature. <br /> BE IT FURTHER RESOLVED that the County Clerk shall forward copies of this <br /> resolution to the Honorable Mayor William P. Kenoi; the Office of the Prosecuting Attorney; the <br /> Police Chief of the Hawaii County Police Department; the Director of the Department of <br /> Transportation, State of Hawai`i; the Chair of the Council of the City and County of Honlulu; the <br /> Chair of the Kaua`i County Council; and the Chair of the Maui County Council. <br /> Page 1 of 2 <br />
