BILL NO. 187 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 3, SECTION 3 -31, PROHIBITED SIGNS, OF <br /> THE HAWAII COUNTY CODE, BY ADDING A NEW SUBSECTION PROHIBITING SIGN <br /> WAVING. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> Section 1. Findings and Purpose. It is the intent of recent <br /> legislation regarding roadside vending to eliminate potential <br /> sources of County liability for traffic accidents which may arise <br /> out of roadside activity. Considering all the accidents and near <br /> misses created by "sign waving" along the roads, the Council finds <br /> that to protect the public and eliminate potential County <br /> liability, sign waving should be prohibited. <br /> Section 2. Chapter 3, Section 3 -31 of the Hawaii County Code <br /> 1983, relating to prohibited signs, is amended by adding a new <br /> subsection to be appropriately numbered and to read as follows: <br /> ( ) No person shall hold signs within 500 feet of any <br /> intersection and wave at passing motorists thereby <br /> constituting a traffic hazard by diverting or tending to <br /> divert the attention of drivers of moving vehicles from <br /> the traffic movement on the public streets and roads. <br /> SECTION 3. New material is underscored. In printing this <br /> ordinance, the underscoring need not be included. <br /> SECTION 4. If any provision of this ordinance or the <br /> application thereof to any person or circumstance is held invalid, <br /> such invalidity shall not affect other provisions or applications <br /> of the ordinance which can be given effect without the invalid <br /> provision or application, and to this end, the provisions of this <br /> ordinance are declared to be severable. <br />
