COUNTY OF HAWAII STATE OF HAWAII <br /> RESOLUTION NO. 158 04 <br /> A RESOLUTION RELATING TO A COUNCIL INITIATED IMPROVEMENT DISTRICT <br /> IMPLEMENTATION STUDY FOR THE CONSTRUCTION OF CERTAIN <br /> WASTEWATER AND SEWER SYSTEM IMPROVEMENTS FOR HOLUALOA, <br /> DISTRICT OF NORTH KONA, HAWAII <br /> WHEREAS, the Council of the County of Hawaii wishes to initiate proposed <br /> improvements on certain real property located at Holualoa, District of North Kona, <br /> County and State of Hawai'i for improvements consisting of an extension to the <br /> municipal sewer system, pursuant to the provisions of Section 12 -10, Hawai'i County <br /> Code, as amended; and <br /> WHEREAS, the US Environmental Protection Agency (EPA) has promulgated <br /> Underground Injection Control regulations on December 7, 1999 which require that <br /> large capacity cesspools existing prior to that date must be upgraded or closed by <br /> April 5, 2005; and <br /> WHEREAS, the "Sewer Policies" outlined in the General Plan states, in part: <br /> • "Private systems shall be installed by land developers for major resort and <br /> other developments along shorelines and sensitive higher inland areas, <br /> except where connection to nearby treatment facilities is feasible and <br /> compatible with the County's long -range plans, and in conformance with <br /> state and county requirements. <br /> • The County shall take immediate steps to designate treatment plant sites, <br /> sewerage pump station sites, and sewer easements according to the facility <br /> plans to facilitate their acquisition. <br /> • The County shall seek State and Federal funds to assist in financing the <br /> construction of proposed sewer systems." and <br /> WHEREAS, in its assessment of the projected sewage flow for the Kealakehe <br /> Wastewater Treatment Plant, the "Kailua -Kona Facility Plan Southern Zone" prepared <br /> for the County of Hawai'i Department of Public Works dated November 1981 identified <br /> the area generally makai of Kuakini Highway between Kailua and Keauhou as the <br /> planning subarea for population projections; and <br />
