(6) Amending Section 310.2. The definition of "Residential Care /Assisted Living <br />Facilities" in Section 310.2 is amended to read as follows: <br />"[ ]ASSISTED LIVING FACILITIES. <br />A building or part thereof housing persons, on a 24 -hour basis, who <br />because of age, mental disability or other reasons, live in a supervised <br />residential environment which provides personal care services[...] and are <br />licensed by the State. Section 310.3 is added as an interim provision until the <br />International Residential Codes are adopted, to read as follows: <br />" 310.3.1 Dwellings and Lodging Houses. Congregate residences (each <br />accommodating 10 persons or less). <br />310.3.2 Construction, Height and Allowable Area. Buildings or parts <br />of building classed Group R because of the use or character of the <br />occupancy shall be limited to the types of construction set forth in Table <br />503 and shall not exceed allowable height as allowed by the IBC. <br />310.3.3 Location on Property. For fire- resistive protection of exterior <br />walls and openings, as determined by location on property, see Section <br />503, Section 601, Section 704, Section 705 and Section 715 of the IBC <br />310.3.4 Access and Exit Facilities and Emergency Escapes. Exits <br />shall be provided as specified in Chapter 10. <br />Access to, and egress from, buildings required to be accessible <br />shall be provided as specified in Chapter 11. <br />Basements in dwelling units and every sleeping room below the <br />fourth story shall have at least one operable window or door approved for <br />emergency escape or rescue which shall open directly into a public street <br />public alley, yard or exit court. The units shall be operable from the <br />inside to provide a full clear opening without the use of separate tools. <br />All escape or rescue windows shall have a minimum net clear <br />openable area of 5.7 square feet. The minimum net clear openable <br />height dimension shall be 24 inches. The minimum net clear openable <br />width dimension shall be 20 inches.
