BHNMPAmendREZ. doc- 6/23/10 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> 1 <br /> HNMP, LLC (PAUL OGASAWARA, MANAGER) <br /> CHANGE OF ZONE ORDINANCE NO. 03 111 (REZ 698) <br /> AMENDMENT TO CONDITION B <br /> HNMP, LLC (PAUL OGASAWARA, MANAGER) has submitted a request to amend <br /> Condition B of Ordinance No. 03 111, which amended Ordinance No. 00 128, which reclassified <br /> 4.901 acres of land from the Agricultural — 1 acre (A -1 a) to Neighborhood Commercial — 20,000 <br /> square feet (CN -20) zoned district. The request is for a 5 -year time extension to complete <br /> construction of the proposed Woodland Center commercial development. The property is <br /> located at the junction of the Pahoa Bypass Road and Keaau -Pahoa Road bordering Kahakai <br /> Boulevard, Keonepoko Iki Homesteads, Pahoa, Puna, Hawaii, TMK: 1 -5- 07:20. <br /> PROPOSED ACTION <br /> 1. Request: The applicant requests an amendment to Condition B of Ordinance No. 03 111 <br /> to allow a five (5) year time extension to complete the construction of a commercial <br /> center known as the "Woodland Center" project. Condition B states: <br /> "Construction of any development on the subject property shall be completed within five <br /> (5) years from the effective date of this amendment. In the event substantial construction <br /> has occurred, but not completed within the five -year period, the Planning Director may <br /> grant an extension of not more than one year. Prior to commencing construction, Final <br /> Plan Approval shall be secured from the Planning Director in accordance with Chapter <br /> 25 -2 -72, 25 -2 -73, and 25 -4 -7 of the Zoning Code......" <br /> 2. Reasons for Request: According to the applicant the time extension is being sought <br /> because the review and approval of plan designs and off -site improvement plans took <br /> unusually long to complete and numerous unanticipated changes and conditions were <br /> sought by approving agencies.
