Assistant Corporation Counsel Office of the Corporation Counsel 101 Aupuni Street, Suite 325 Hilo, HI 96720 -4262 Dear Attorney Takase: SUBJECT: Dedication Deed: Hualalai Heights Subdivison Grantor: International Development Projects /Pualani Estates (Final Subdivision Approval No. SUB 7921) Proposed Dedication of Roadway Lots (Lot A, Lot B, Lot F, Lot H) TMK: (3) 7-5-043:029, 053 (por.) and 128 (por.); Puapuaanui 1st, North Kona, Hawaii We are in receipt of a copy of the draft dedication deed for the dedication of Roadway Lots A, B, F, and H. Please note that these roadway parcels are located within the Hualalai Heights Subdivision. We apologize for the delay in responding to your request. We have no objections to the execution of the dedication deed provided that all roadway and water system improvements are constructed in accordance with the approved subdivision construction drawings. Also note that the dedication of these roadway lots is required by Condition F of Change of Zone Ordinance No. 95 -100, which rezoned the project site to a Single Family Residential (RS 20) zoned district. This ordinance required a county - dedicable road through the subdivision, including its connection with the Pualani Estates Subdivision and with Hualalai Road. We believe that this work has already been completed, but should be confirmed with the Department of Public Works. Final Subdivision Approval for this particular subdivision was issued by this office on July 08, 2005.
