V OF <br />COUNTY OF HAWAII :• STATE OF HAWAII <br />'FTC OF • N F, <br />RESOLUTION NO. 40 11 <br />A RESOLUTION DIRECTING THE DIRECTOR OF FINANCE TO CEASE AND <br />DESIST NEGOTIATIONS FOR THE ACQUISITION OF TMK(S) 1 -3 -1:74 AND <br />1 -3 -1:83, KNOWN AS THE PAHOA STEAM VENTS, IN THE DISTRICT OF PUNA. <br />WHEREAS, Resolution No. 178 -09 directs the Director of Finance to enter into <br />negotiations for the acquisition of TMK(s) 1 -3 -1:74 and 1 -3 -1:83, pursuant to Chapter 2, Article <br />36 of the Hawaii County Code 1983 (2005 Edition, as amended); and <br />WHEREAS, Chapter 2, Article 36 of the Hawaii County Code 1983 (2005 Edition, as <br />amended), established the Geothermal Relocation and Community Benefits Program as a guide <br />for the use of the funds available in the program; and <br />WHEREAS, "community benefits" should be determined and prioritized by members of <br />the community and implemented by government leaders; and <br />WHEREAS, upon conducting further research, having many discussions with <br />community members, and realizing there are limited funds and important needs prioritized that <br />address health or safety issues in the district, it is necessary to bring this measure forward in a <br />timely manner; now, therefore, <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the <br />purpose of Resolution No. 178 -09 has not been prioritized as a health or safety issue and <br />therefore would not be an appropriate use of the funds at this time, and that the Director of <br />Finance shall cease and desist negotiations for the acquisition of TMK(s) 1 -3 -1:74 and 1 -3 -1:83, <br />known as the Pahoa Steam Vents. <br />
