Lot No. Twenty (22) , Block No. One Hundred Six (106) , <br /> situate in the County and State of Hawaii, as shown on the <br /> map of HAWAIIAN OCEAN VIEW ESTATES, duly recorded in the <br /> Bureau of Conveyances of the State of Hawaii as File Plan <br /> No. 787, in Liber 4255, at Pages 474-476. <br /> TOGETHER WITH an undivided 1/11,500th fee simple interest <br /> in and to all roadways located within the above-mentioned <br /> Subdivision, together with a perpetual non-exclusive <br /> easement-of-way in common with all other owners from time to <br /> time of lands therein, in, over, under and across all of said <br /> roadways, for all ingress, egress and utility purposes; <br /> PROVIDED, HOWEVER, in the event it shall at any future time <br /> be deemed desirable by the COMMITTEE having control of the <br /> Road Maintenance Escrow Fund heretofore established to convey <br /> the said roadways or any portion of them to any proper <br /> governmental authority which shall undertake the maintenance <br /> of said roadways, the ownership and easements herein set <br /> forth shall, to the extent necessary, be forthwith <br /> terminated, and the Grantee herein does hereby irrevocably <br /> appoint said COMMITTEE and its successors its <br /> attorney-in-fact to make such conveyances. <br /> BEING THE SAME PREMISES conveyed to the Grantor herein by <br /> Deed of Grayco Land Escrow, Ltd. , dated June 22, 1972, and <br /> recorded in the Bureau of Conveyances of the State of Hawaii <br /> in Liber 8436, at Page 438-439. <br /> EXCEPTING AND RESERVING to the State of Hawaii all mineral <br /> or metallic mines of every description. <br /> TO HAVE AND TO HOLD the same, together with all rights, <br /> improvements, easements, privileges and appurtenances thereunto <br /> belonging or in anywise appertaining, or held and enjoyed <br /> therewith, unto the Grantee, its successors and assigns, in fee <br /> simple, forever. <br /> AND the Grantor, for himself, his heirs, personal <br /> representatives and assigns, does hereby covenant with the <br /> Grantee, its successors and assigns, that he is seised in fee <br /> simple of the above-described premises; that the same is free and <br /> clear of and from all encumbrances, except as aforesaid; that he <br /> -2- <br />
