BHolualoalnnREZAmendDBugado .doe -1/26/ 11 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> HOLUALOAINN <br /> CHANGE OF ZONE ORDINANCE NO. 03-162 (REZ 694) <br /> AMENDMENT TO CONDITION B <br /> HOLUALOA INN is requesting an amendment to Condition B (complete construction) <br /> of Ordinance No. 03 -162, which amended Ordinance No. 91 -91 that changed the district <br /> classification of the project area from Agricultural -1 acre (A -la) to Village Commercial -1 acre <br /> (CV -la). The project area is situated along the makai side of the Mamalahoa Highway, and <br /> includes the H61ualoa Inn in H61ualoa Village, H61ualoa 1 St and 2 North Kona, Hawaii, <br /> TMK: 7 -6 -008: 005 (portion). <br /> RE UEST <br /> 1. Request: Amendment to Condition B of Ordinance No. 03 -162 to allow for an <br /> additional 3 years by which to complete its proposed commercial development. <br /> Condition B, as currently written, required completion of the commercial development by <br /> December 18, 2008. (Exhibit 1 -December 6, 2010 Amendment to Change of Zone <br /> Request) <br /> More specifically, the applicant is requesting that Condition B of Ordinance No. 03 -162 <br /> be amended as follows: <br /> "B. Construction of the proposed development shall be completed within [ fie (3) <br /> three 3 years from the date of this amendment. Final Plan Approval by the <br /> Planning Director in accordance with the Zoning Code shall be secured by the <br /> applicant prior to the commencement of construction. Development plans shall <br /> identify existing and proposed structures, fire protection measures, paved <br /> driveway accesses and parking stalls and other improvements associated with the <br /> proposed use. Landscaping shall be included in the development plans to mitigate <br /> any potential adverse noise or visual impacts to adjacent properties in accordance <br /> with the Planning Department's Rule No. 17 (Landscaping Requirements)." <br />
