Hotel St., Ste. 107 Honolulu, HI 96813 Dear Ms. Joesting: RE: Appeal from Denial of Request for Records (APPEAL 10 -11) Thank you for your letter dated March 17, 2011 to the County of Hawaii Office of the Mayor concerning the above appeal (letter enclosed). We respond on behalf of the County of Hawaii and provide a copy of this letter to Mr. Dan Cole to ensure he is given the reasons the requested documents were not provided to him. We respond to each of Mr. Cole's requests below. 1. "A copy of the 4 June, 2009 telephone message to you, Mayor Kenoi, from Dan A. Cole as recorded in writing by your staff member Irma, RE: Government Corruption and your involvement in racketeering activities." The Mayor's Office does not have this document (I cannot confirm one was ever created). However assuming this telephone message slip did exist and was available, such telephone message slips are used for the Mayor's convenience only, and are not required to be maintained. For this reason, and pursuant to OIP Opinion Letter No. 04 -17, the County of Hawaii submits these telephone message slips are not required to be maintained or produced pursuant to a UIPA records request.
