At this time I am also requesting the minutes of the meeting where Board Member Arne Henricks disqualified himself from sitting in judgement on Petition No. 2011 -07, RE: Hawaii County Fiance Director Nancy Crawford's alleged violations of the Hawaii County Ethics Code during the commission of apparent violations of United States Code 18 U.S.C. 1344 Bank Fraud. It is noted that Board Member Hendrick had already participated in, conducted deliberations on, and voted on Petition No. 2011 -07 at the last meeting of the Board on Wednesday, March 9, 2011. However during the portion of the May 11, 2011 Board's meeting when it came time for Petition No. 2011 -07 identified as UNFINISHED BUISNESS in the Board's agenda, Chair John Dill disqualified himself from further participation on the matter because of Public Statements and Testimony he made before the Hawaii County Council and made after the March Ethics Board Meeting, RE: Bill 311 where such statements and testimony might be construed as prejudicial due to the nature of the Finance Director's relationship to Bill: 311, $56M Bond Authorization of County General Obligation Bonds which Petition No. 2011 -07 pertains to. It was immediately after Chair Dill announced his disqualification in the May meeting that Counsel to the Board Renee N.C. Schoen announced that Board Member Arne Henricks had also disqualified himself and therefore there was not a quorum of the Board to conduct a hearing, and that no hearing of the Board could be conducted on Petition No. 2011 -07 until the appointment and confirmation of a new member to fill the vacant Board seat.
