Hawaii State Association of Counties (HSAC) <br />Counties of Kaua`i, Maui, and Hawaii, and City & County of Honolulu <br />RESOLUTION REQUESTING THE STATE LEGISLATURE TO ADOPT <br />HOUSE BILL 1521 (HB 1521) RELATING TO AN AMENDMENT TO CHAPTER <br />339D, HAWAII REVISED STATUTES, REGARDING ELECTRONIC WASTE <br />RECYCLING. <br />WHEREAS, on January 1, 2009, Act 13 became law establishing responsibilities <br />on retailers, manufacturers and the State Department of Health to encourage recycling of <br />electronic devices sold within the State by establishing an electronic device recycling (e- <br />recycle) program; and <br />WHEREAS, Act 13 clearly provides the intent to encourage electronic device <br />recycling, however it falls short of requiring the methodology by which the relevant <br />parties are required to minimally satisfy the intent; and <br />WHEREAS, HB 1521 was entered in the 2011 Legislative Session as a Bill for an <br />Act to add four new sections to Chapter 339D, Hawai`i Revised Statutes, that address <br />market share, liability for stored information, environmental management and state <br />procurement; and <br />WHEREAS, HB 1521 was heard and successfully passed first reading out of the <br />Committee on Energy and Environmental Protection and the Committee on Economic <br />Revitalization and Business; and <br />WHEREAS, HB 1521 has been referred to the Committee on Finance for the <br />2012 legislative session; and <br />WHEREAS, the State of Hawai`i and its respective counties incur increased cost <br />and expense of air and sea transportation for interisland and world movement of products <br />for e- recycling, however, the City and County of Honolulu currently engages in some <br />measure of drop -off commercial e- recycling; and <br />WHEREAS, neighbor islands in the State of Hawai`i have insufficient quantities <br />of electronic devices to support commercial e- recycling businesses and must depend on <br />expensive and prohibitive government subsidies to maintain an e- recycle program; and <br />WHEREAS, the current requirement that manufacturers offer a recycle option is <br />satisfied by costs to the consumer for expensive and woefully inadequate mail -back <br />programs; and <br />WHEREAS, representatives from all counties within the State have submitted <br />testimony in favor of HB 1521, which included modifications to strengthen the e- recycle <br />responsibility of the manufacturer and to support the provision not to accept manufacturer <br />plans that contain mail -back options; and <br />3371 -A Wilcox Road, LThu`e, Kauai, Hawaii 96766, (808) 241 -4188 <br />
