No. 369/Bill No. 101 <br /> PLACE: Council Chambers <br /> Kona, Hawai'i <br /> TIME: 3:04 p.m. <br /> Council Chair and Members <br /> Hawai`i County Council <br /> Hilo, Hawai`i 96720 <br /> Your Committee on Planning, to which was referred Bill No. 101, reports as follows: <br /> Bill No. 101, transmitted by Mayor William P. Kenoi, via Communication No. 369 dated <br /> September 8, 2011, is an ordinance amending the Puna Community Development Plan, as <br /> adopted by the Ordinance No 80 -116 and amended, by Ordinance No, 10 -104, relating to <br /> formatting and clerical revisions. <br /> At the October 4, 2011 Planning Committee, County of Hawai`i Planner Larry Brown and Puna <br /> Community Development Plan Action Committee (PCDP -AC) Chair Dan Taylor were present <br /> and stated that Bill No.101 addresses clerical and formatting errors in the Puna Community <br /> Development Plan (PCDP). <br /> Several Council Members had concerns that the amendments in Bill 101 were substantive. They <br /> stated that in Section 3.5.3c. 3) parts (4) and (6) the word "develop" was not a strong enough <br /> verb and that "build" or "construct" would be more appropriate. They also stated concerns with <br /> Section 3.1.3h of the Implementation Table and the definition of the word "fix ". Other concerns <br /> were the addition of "in the coastal zone" in Section 2.4.3b of the Implementation Table and <br /> they felt the deletion of Section 4.2.3e and added language to Section 4.2.3b.3 regarding express <br /> bus service for commuters from Pahoa to Hilo and Volcano to Hilo might also constitute a <br /> substantive change to the PCDP. <br /> Bill No. 101 was postponed with 8 ayes and 0 noes until the October 18 Planning Committee <br /> meeting to allow the PCDP -AC time to review and make comments on the amendments. <br /> At the October 18, 2011 Planning Committee, Council Member Yoshimoto confirmed all <br /> members had Communication 369.1 and asked Larry Brown and Dan Taylor to come forward. <br /> Deputy Corporation Counsel Julie Mecklenburg was also present for questions. <br /> Mr. Brown stated the PCDP -AC met on October 11; 2011 to address the items of concern that <br /> the Council Members raised at the October 4, 2011 Planning Committee meeting. Their <br /> response is contained in Communication 369.1. The Action Committee states that they do not <br /> consider these substantive changes and they support them as they bring clarity to the PCDP. <br /> PC Rept. No.: 30 <br />
