COUNTY OF HAWAII STATE OF HAWAII BILL NO. ORDINANCE NO. 1: 90 83 AN ORDINANCE DESIGNATING TAX MAP KEYS (3) 2 -4- 060:001 AND (3) 2 -4- 029:028 AS "MACHADO ACRES PARK" PURSUANT TO CHAPTER 15, ARTICLE 8, SECTION 15 -67, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED) AND AMENDING CHAPTER 15, ARTICLE 8, SECTION 15 -68.1, HAWAII COUNTY CODE 1983 (2005 EDITION, AS AMENDED) BY ADDING "MACHADO ACRES PARK" TO THE PARKS AND RECREATIONAL FACILITY SCHEDULE. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: SECTION 1. Purpose. The purpose of this ordinance is to designate the name "Machado Acres Park" to the open area situated at Waiakea, South Hilo, County and State of Hawai`i, Tax Map Keys (3) 2- 4- 060:001 and (3) 2 -4- 029:028 pursuant to chapter 15, article 8, section 15- 67(a)(2)(A), Hawai`i County Code 1983 (2005 Edition, as amended), which provides that an "open area" shall be named for its neighborhood, community, region, district or other identifying geographical location. Ordinance No. 98 -105 rezoned the parcels in Machado Acres Subdivision to RS -10, and Condition "B" required that Machado Acres Association dedicate the subject two parcels (3.994 & 3.923 acres, more or less) situated at Waiakea, South Hilo, County and State of Hawai`i, Tax Map Keys (3) 2 -4- 060:001 and (3) 2 -4- 029:028 to the County for a park site. Resolution No. 95 -03 was adopted on November 19, 2003, accepting dedication of the two parcels from Machado Acres Association to the County of Hawai`i for the purpose of creating a park. A community meeting was held and all those in attendance unanimously agreed that the park be named "Machado Acres Park." SECTION 2. Notwithstanding any other law to the contrary, the open area situated at Waiakea, South Hilo, County and State of Hawai`i, Tax Map Keys (3) 2 -4- 060:001 and (3) 2 -4- 029:028 is hereby named "Machado Acres Park." SECTION 3. Chapter 15, article 8, section 15 -68.1, Hawai`i County Code 1983 (2005 Edition, as amended), relating to the parks and recreational facility schedule, Parks, Hilo /Hamakua, is amended by adding the following facility to be appropriately inserted and to read as follows: "Machado Acres Park" SECTION 4. New material is underscored. In printing this ordinance, the underscoring need not be included.
