PC-46 Page 2 April 3, 2012
Council Member Smart asked the applicant to clarify their position and asked if they had
suggested the one-way road as an alternative. She further asked for clarification on the utility
pole relocation and the burden on the applicant to move it.
Mr. Arai replied that the utility pole is located on County land and because the applicant has
requested a rezoning the burden of relocating the utility pole falls on the applicant, as it would
with anyone requesting a zoning change.
Mr. Goodenow stated that the applicant's first position was not to follow the County's suggested
standards for the road and the one way road was their suggestion as an alternative at the Planning
Commission.
Council Member Yagong asked if the utility pole would be moved to the applicant's property.
He further stated that he supports the bill and is looking forward to Council Member Ford's
amendments.
Mr. Arai stated the utility pole belongs to Hawaiian Electric Light Co. (HELCO) and the new
location is unknown until HELCO's engineer has evaluated the situation.
Committee Chair Hoffmann stated that he cannot support this bill solely due to the inclusion of a
fair share clause.
Your Committee on Planning is in accordance with the purpose and intent of Bill 219, and
recommends its passage on first reading.
mkh
AYES NOES A&E EX Respectfully submitted,
BLAS X
FORD x COMMITTEE ON PLANNING
HOFFMANN X
IKEDA X
ONISHI X
PILAGO XU4/0 4)
SMART x PETE HOFFMANN,rAIR
•
YAGONG X PC REPO''l NO. 46
YOSHIMOTO X ADOPTED: /0 2 21 2
