J�jV Gi N� <br /> COUNTY OF HAWAII �� `;£'��t- STATE OF HAWAII <br /> RESOLUTION NO. 291 12 <br /> A RESOLUTION REQUESTING THAT THE PUBLIC ACCESS, OPEN SPACE AND <br /> NATURAL RESOURCES PRESERVATION COMMISSION IDENTIFY THE <br /> COASTAL LANDS OF `O`OMA II, IN THE DISTRICT OF NORTH KONA, COUNTY <br /> OF HAWAII,AS NUMBER ONE ON THE PRIORITIZED LIST OF QUALIFYING <br /> LANDS WORTHY OF PRESERVATION. <br /> WHEREAS, article 42, section 2-217, Hawai`i County Code 1983 (2005 Edition, as <br /> amended), provides, in part, that the Public Access, Open Space, and Natural Resources <br /> Preservation Commission shall develop and submit to the Mayor a list of qualifying lands worthy <br /> of preservation and further, that the Commission update this list at any time, but at least annually <br /> by December 31 of each year; and <br /> WHEREAS, the Hawai`i County Public Access, Open Space and Natural Resources <br /> Preservation Commission in its 2007 and 2011 Annual Report to the Mayor included `O`oma II <br /> in its island-wide prioritized list (hereinafter the "Property"); and <br /> WHEREAS, in December 2011, the State Land Use Commission denied a request to <br /> amend the Conservation Land Use District Boundaries into the Urban Land Use District for <br /> certain lands situate at `O'oma II, consisting of approximately 181.169 acres, Tax Map Key <br /> Numbers (3) 7-3-009:004; and <br /> WHEREAS, the December 2011 decision of the State Land Use Commission was in <br /> accordance with two previous requests to reclassify the property to the Urban designation, which <br /> were also denied; and <br /> WHEREAS, `O`oma II is one of the last available open space parcels that is in close <br /> proximity to the growing urban center in Kailua-Kona, and contains a widely used lateral beach <br /> access road that would be a natural continuation of the future County of Hawai`i shoreline park <br /> at adjacent Kohanaiki; and <br /> WHEREAS, in the last 20 years the community has worked valiantly to protect and <br /> preserve this special piece of shoreline for the benefit of the community; and <br /> WHEREAS, at the August 1, 2012, meeting of the Hawai`i County Council, the Council <br /> adopted Resolution No. 276-12 with a unanimous vote, which requested that the Mayor <br /> authorize the director of finance to enter into negotiations for the acquisition of Tax Map Key <br /> Numbers (3) 7-3-009:004 and (3) 7-3-009:022, known as the coastal land of`O`oma II; and <br />
