PPG <br /> 'x.tug. 92b <br /> en <br /> Hawaii County Planning Committee <br /> Opposition to Bill 168 2r " _, WJ s 25 <br /> Change of Zone Application RS10-CV10 TMK(3) 1-08-002:064 <br /> July 30, 2012 <br /> Aloha, <br /> My name is Susan Langer and I reside with my family at 18-1358 Nichols Road, <br /> Mountain View. <br /> Our neighborhood is a sleepy little road of mostly plantation bungalows. Many of <br /> our neighbors have restored their homes rather than replace them. My family <br /> lives in the old plantation field manager's house. Historical documentation <br /> suggests our property was the site of the 1895 halfway house, a rest stop for <br /> travelers to Volcano. We love our neighborhood and feel we should preserve the <br /> old Hawaii charm and natural beauty of this historic Mountain View area. <br /> Simply put, this is a residential family neighborhood; it is not the place for an <br /> auto repair shop. <br /> Our opposition to Bill 168 is completely supported by the Planning Director's <br /> unfavorable recommendation dated 10/5/11. <br /> This document states: <br /> "...as properties along Nichols Road as well as across Highway 11 are mostly in <br /> residential uses, it would be more prudent to retain the largely residential <br /> character of the neighborhood along Nichols Road. This is further supported by <br /> the GP LUPAG map which identifies the property as Low Density Urban." <br /> "...change of zone to Village Commercial (CV-1o) would allow other commercial <br /> uses to be established on the property...These uses allowed in a commercial <br /> zoned district would clearly not be compatible in this largely <br /> residential area." <br /> "Thus, to establish the automobile repair shop in a CV zoned district, it would be <br /> necessary to obtain a concurrent General Plan Amendment and Change of Zone. <br /> However, the Director is not in favor of a General Plan Amendment to <br /> accommodate the proposed use." <br /> "Based on the above, the request for a Change of Zone...would not result in an <br /> appropriate land use pattern and would not further the public convenience, <br /> necessity and general welfare." <br /> In addition to points made in the original unfavorable recommendation, the <br /> Hawaii County Code 25-4-13, does not permit commercial auto repair shops as <br /> home occupations. We ask how a commercial auto repair shop in the front yard <br /> of a residence in a residential neighborhood is different from a "home <br /> occupation"? <br /> Comm.
